Language Assessment Battery-Revised (LAB-R)
Upon admission to a NYS public or charter school, all students who live in a home where a language other than English is spoken, as confirmed by the Home Language Questionnaire, are assessed with the LAB-R. The LAB-R is administered only once to determine placement eligibility into either a bilingual or ESL program.

New York State English as a Second Language Achievement Test (NYSESLAT)
The NYSESLAT is administered annually in spring to LEP/ELLs in grades K – 12 in all public and charter schools to determine English language proficiency and mandated services for the following year. Building principals receive ordering information from Harcourt Assessment, Inc. in March of each year.

NYSESLAT Memo regarding LEP/ELL Student Statewide Assessment Policy/Title 1 Requirement NYSESLAT can no longer be used for Title I accountability purposes. However NYSESLAT must continue to be administered annually to all LEP/ELL until they reach proficiency.

LEP/ELLs are required to take all NYS assessments with one exception regarding the Grades 3-8 ELA examination.

Accommodations for ELLs by Test (Grades 3-8)
Testing accommodations may be provided to all LEP students (and former LEP students for up to two years) on state assessments. These accommodations are listed in the School Administrator’s Manuals (SAMs). The information is on page 5 of most manuals right below accommodations for students with disabilities under the heading, LEP Students.
Accommodations for ELLs by Test (Grades 9-12)
Testing accommodations may be provided to LEP students (and former LEP students for up to two years) on Regents Examinations and Regents Competency Tests. Descriptions of these accommodations can be found in Section Two of the School Administrator’s Manual, 2008 Edition.
Extension of Testing Accommodations to Former English Language Learners
Schools are now permitted to provide testing accommodations on New York State examinations to former limited English proficient/English language learners (LEP/ELLs) for up to two (2) years
